Regulations: Progress of AI Legislations in the US

Artificial Intelligence (AI) will continue to evolve and make groundbreaking progress across all industries. In legal technology, a growing number of AI applications and software are being in demand which alters how the legal industry does its work. Thus, companies that are now using AI should be mindful of the regulations surrounding it.

In the US, several government agencies like the Department of Commerce (DoC), the Federal Trade Commission (FTC), the E.U.-U.S. Trade and Technology Council (TTC), and the National Security Commission on Artificial Intelligence (NSCAI) are starting to create a framework to its regulation.

Below are existing developments related to AI regulation in the U.S:

  • Under the National AI Initiative Act of 2020, the National Artificial Intelligence Advisory Committee (NAIAC) is formed to "to advise the President and other federal agencies on a range of issues related to artificial intelligence (AI)".
  • A memo was released by FTC declaring that they are vigilant on biases of the algorithms.
  • TTC released a joint statement on its commitment to AI development and also its responsibility in OECD's Recommendations on AI.

Currently, there is no federal law for AI but several states have laws related to its use:

  • Illinois’ Artificial Intelligence Video Interview Act (AIVIA) obligates employers who use video interview technology for hiring to disclose the information and obtain consent from applicants.
  • Colorado passed SB 21-169 protecting consumers against discriminatory practices of insurance companies on their AI systems.
  • The creation and/or distribution of deep fake videos with AI are banned in Texas by passing Texas SB-751.
